Lawsuit claims firings violated constitutional rights amid political pressure
Former FBI agents sue Patel claiming they were fired for work on Trump election conspiracy case
Two former FBI special agents sued agency director Kash Patel in federal court today, alleging that they were fired for their work on the investigation into President Trump’s alleged efforts to overturn the 2020 election.
The agents, who filed anonymously in Washington, D.C., said Patel fired them last fall after Trump and his supporters pushed for their removal. Patel had called agents involved “corrupt actors” who “weaponized law enforcement” and dismissed them without a hearing or investigation, the lawsuit says.
They were assigned to the probe that led to Trump’s 2023 indictment on charges of allegedly conspiring to block certification of his loss to Joe Biden. The Justice Department dropped the case in 2024 after Trump’s reelection. The lawsuit seeks reinstatement and claims the firings violated their constitutional rights to free speech and due process. An FBI spokesperson declined to comment.
The agents said they worked in the Washington field office, had strong performance records, and were assigned outside their usual duties to the FBI’s “Arctic Frost” investigation into an alleged fake electors scheme, where they had minor roles.
During the 2024 campaign and after the election, Trump and his allies vowed to target government employees they viewed as politically opposed to him, with a focus on the FBI. Trump referred to agents involved in Arctic Frost as “total scum” and “Radical Left Lunatics,” the lawsuit says.
Both agents were fired between late October and early November 2025 and received termination letters that did not cite poor performance or misconduct. They say they have been unable to find new jobs, partly because the letters bar future Executive Branch employment and because prospective employers fear harming ties with the Trump administration.
