NJ Panel to Discuss Bill Creating State Rent Control Enforcement Office
The New Jersey Senate Community and Urban Affairs Committee will meet tomorrow to discuss a newly introduced bill that would create a state office to oversee local rent control laws and give tenants a direct way to challenge alleged illegal rent increases.
The measure would establish a Rent Control Enforcement Unit within the New Jersey Department of Community Affairs. The unit would investigate complaints from residential tenants who say their landlord violated a municipal rent control ordinance or other local rent restriction.
The bill would let tenants ask a new state enforcement unit to review rent increases they believe exceed local limits. It would supplement, not replace, municipal processes, and tenants could be required to exhaust local remedies before seeking state intervention.
In Lakewood, landlords who provide heat may raise rent once a year by up to 6.5% over the prior base rent; those who do not provide heat are capped at 5%. The rules apply to covered residential rentals, though some newer buildings are exempt, and higher increases are allowed for substantial repairs or capital improvements.
Led by a director appointed by the commissioner of community affairs, the unit would operate a helpline and online portal. If it finds a violation, it could order a rent reduction, potentially to the lowest rent charged in the prior 12 months, impose a civil penalty of up to four months’ rent, or allow a tenant to terminate a lease early. The bill defines “local rent restriction” broadly to include municipal rent control, rent stabilization or leveling ordinances, and rent limits on low- or moderate-income housing under the state’s Fair Housing Act.
