Appeals court dismisses case challenging Alien Enemies Act, does not address question of Trump’s use of the wartime law
A U.S. appeals court has dismissed a case challenging the Trump administration’s use of the Alien Enemies Act to deport alleged Venezuelan gang members.
The U.S. Court of Appeals for the 5th Circuit dismissed the case on Thursday because the three plaintiffs challenging the invocation of the obscure law were deported.

The Alien Enemies Act of 1798 is a wartime federal law that allows the president to apprehend, restrain, secure, and deport citizens or natives of an enemy nation during an invasion or war without standard immigration due process hearings.
